PRACTICE AREA:   CIVIL RIGHTS

We usually think of civil rights cases - those that involve the misuse of authority- as cases that are dealt with in federal court. These kinds of cases involve violations of the right to speak freely, to be arrested with reasonable force, to be free from unwanted searches and seizures, and other violations of the rights we have under the Constitution.

I have represented persons injured by the unlawful actions of the police in federal court. To do this successfully requires knowledge of the criminal law and training in civil rights cases; those under 42 U.S. Code section 1983.

New Jersey recently enacted a state civil rights law, which is broader than the federal law. This law permits you to sue for violations of your state and federal constitutional rights in state court. Often your rights under the state constitution are broader than under the federal constitution.

If you have been beat up by the police, arrested because you cursed at a cop, stopped for no reason, locked up for minor crimes or strip searched for a motor vehicle infraction, contact Mitch Ignatoff at 732-356-2212. 800-400-6908 or by clicking here
