Penalties
In New Jersey the penalties for drug distribution/ drug
trafficking depend on the quantity and type of drug. In general
- A third degree crime results in 3-5 years in prison;
- A second degree crime results in 5-10 years in prison;
- A first degree crime results in 10-20 years in prison.
Distribution of marijuana, crack, cocaine, methamphetamine,
prescription drugs, heroin, hallucinogens- all these can result
in severe penalties.
Increased Prison Time
These charges significantly increase prison time
- Possession with intent to distribute within 1,000 feet
of a school zone- this will increase the penalty to 3 years
mandatory prison time.
- Possession with intent to distribute within 500 feet of
a public library, public housing or public park - These
carry sentences of 5-10 years in jail.
- Possession of a hand gun with any drug offense - this
charge requires the gun possession charge to be tried in
with the drug case. This charge can result in 10 - 20 years
in prison.
