Conspiracy is an agreement by 2 people to commit a
crime. Any crime.
Under sate law there is not much difference between
conspiracy and attempt to commit that crime. The person must
take a substantial step towards completion of the crime to be
guilty of attempt to commit that crime.
Federal law requires much less of a substantial step,
however. The punishment is greater too.
Conspiracies take a great deal of work by the government to
prove. They often involve wiretaps, many documents, and many
hours of recordings. The government will assert that the
conversations are in code.
