When you are found guilty or have pleaded guilty you can appeal both the finding of guilt or the penalty, or both. The reason for an appeal is because the judge acted outside the law. It can be that the judge below, or the jury reached an obviously wrong conclusion. Great care must be taken to review the instructions the judge gave to the jury since wrong instructions often result in a new trial being given.

A municipal appeal is from the decision of a municipal court judge. It must be filed within 20 days. A superior court judge examines the record. He can make new findings, and find you not guilty.

An appeal from the Superior Court is heard in the Appellate Division. These appeals must be filed within 45 days.

Appeals to the New Jersey Supreme Court must be made within 20 days of the decision of the Appellate Division.

POST CONVICTION RELIEF

Post conviction relief is where the error was not made by the court, but by your attorney. Sometimes a seriously better cross examination is needed. Sometimes you did something on your attorney’s advice that turned out to be wrong.

Convictions can be set aside-vacated- for various reasons. Failure to inform you of immigration consequences. Failure to be advised of other consequences of conviction.
