OPENING YOUR DWI CONVICTION

    In New Jersey you can re-open a previous DWI conviction in certain instances. If you are facing a conviction for a second or third time DWI, reopening the prior or previous conviction(s) will reduce the severity of the sentence you are facing for your present DWI charge.Or, if you are charged with driving while suspended due to a DWI conviction, reopening the DWI conviction may result in a not guilty finding. Considering the penalties you are facing of up to 90 days in jail, this may be a good idea.

    Reopening a DWI conviction is an involved process. You must show that you really may have been innocent of that DWI charge. You may have to show that your prior attorney didn't know what he was doing. And there is a time period - generally five years from the date of conviction - which must be met. You really need to sit down with an attorney to discuss this. I have successfully reopened, and then won, a number of DWI convictions, saving my clients from jail and/or long license suspensions.
